Terms and Conditions

The following terms and conditions will apply in all circumstances when we have been instructed to move a vehicle, whether that be a verbal or written instruction and with or without an order number.

Telephone calls

All calls to and from the Wedelivercars.co.uk office (01543 622777) are recorded for quality and training purposes.

Insurance

Public Liability – £5,000,000

Motor Fleet (Driven) – £100,000

Goods In Transit – £1,000,000 (can be increased on request)

Please note, Wedelivercars.co.uk do not accept any responsibility for consequential losses.

Our Drivers

All drivers are handpicked and trained in person by wedelivercars.co.uk and work on a freelance basis, all undergo a high level of compliance including a DBS check and regular licence checks.

Waiting Time

We allow 30 minutes on site before waiting time is charged. This is charged at £30 per hour plus VAT.

Delivery and Collection of Electric Vehicles

All vehicles must have a minimum of 90% charge when we arrive to collect the vehicle, otherwise the movement may be cancelled. Should the vehicle need charging on route customers will be charged the waiting time fee listed above. This fee is not associated with the amount of electricity the vehicle requires, it is for waiting time taken for a charge point to become available and the time taken whilst the vehicle is being charged. The cost of the charge itself is treated in the same manner as fuel and is fully rechargeable and will be included on your invoice, proof of our cost can be provided on request. Please note that some vehicles/ journeys may require multiple charges and the vehicle may have additional miles added should the driver need to go off route to find a suitable charging point.

Damage in Transit

Like most trade policies, our insurance does not cover punctures, glass damage or damage from road debris so in turn wedelivercars.co.uk do not cover this either. This is viewed to be no fault of ours as the damage would occur whoever was in charge of the vehicle.

Motoring Offences & Nominations – including speeding fines, toll charges and parking tickets

While the vehicle is under the control of Wedelivercars.co.uk we are responsible for any of the above. Due to covert cameras the driver generally has no idea if he has exceeded a speed limit or has overstayed in a car park. In any event the registered keeper will receive the enforcement notice relating to the offence.

It is imperative that the person that receives the notice or summons complies with the law and fill in the relevant section on the fine or the enforcement notice stating that they were not in control of the vehicle at the time of the offence, this is generally section B or section 2.

Wedelivercars.co.uk will honour their responsibilities to pay any of the above offences as long as the request for information has been completed by the registered keeper in a timely manner. If the notice has been ignored and the fine has been escalated. Wedelivercars.co.uk will only be responsible for the original charges relating to the offence.

Although the original offence may have been caused by an agent Wedelivercars.co.uk unless the registered keeper of the vehicle has absolved his/her liability by completing the relevant section on the enforcement notice they will always be liable under English Law.

Collection and Delivery Reports

When you instruct us to move a vehicle, we also make a record of the exterior condition on a digital vehicle condition report which both parties’ sign. All our drivers are trained to report on a vehicles cosmetic condition. If our driver has misreported on the digital vehicle condition report any missed defects to the vehicle’s exterior, then the responsibility will be with wedelivercars.co.uk. Our drivers/appraisers will ask you to sign a digital vehicle condition report on delivery of the vehicle to you. Once the vehicle has been inspected and the digital vehicle condition report has been signed by you or by a representative of you, Wedelivercars.co.uk will have no further liability and cannot be held liable for its condition or be responsible for any future claims as to its roadworthiness, mechanical or cosmetic condition. If the vehicle is inspected in poor weather/light conditions, or is excessively soiled, it may not be possible to produce an accurate inspection report. This will be noted on the digital condition report and in these circumstances wedelivercars.co.uk will not be responsible for damage subsequently identified.

Inspect & Collect – Vehicle Condition Reports

Wedelivercars.co.uk, its staff and freelance drivers cannot give any guarantees. Vehicle condition reports or vehicle appraisals are based on the opinions of the driver/appraiser following a visual assessment as to the condition of the vehicle at the time of the inspection. Where a road test is conducted the report is based on the opinions of the driver/appraiser in the limited time allowed to get the vehicle up to the normal operating temperature.

Rectification Charges

If it has been agreed that Wedelivercars.co.uk has a responsibility to pay for any rectification, those charges must be supported by a bona fide invoice and be invoiced at cost price, price must be agreed ahead of the commencement of works. On production of a bona fide invoice at cost price your invoice will be paid within 30 days.

Breakdown

Where breakdown cover has not been taken out and a breakdown occurs, £200.00 plus VAT, will be charged to get the vehicle to its onward destination. Any chargeable parts/lubricants required by the breakdown agent to ensure the onward movement for the job to be completed are chargeable to the customer. Wedelivercars.co.uk are covered by the AA for breakdowns.

Wedelivercars.co.uk cannot be held responsible for any mechanical defect encountered whilst in transit unless due to proven driver negligence. Our drivers are instructed to find a safe and suitable area to pull over should the vehicle encounter a fault which in the case of a Smart Motorway will usually mean continuing to the next refuge area.
